Users
The access and/or use of this ELRA Website attributes the condition of USER, who accepts, from the mentioned access and/or use, the General Terms reflected herein.

Access and/or use of this Website

The ELRA Website provides access to a multitude of information, services, programs or data (hereinafter, the «Contents») on the Internet belonging to ELRA or its licensors to which the USER may have access. The USER assumes responsibility for the use of the Website. This responsibility extends to the registration required to access certain services or content. In this registration the USER will be responsible for providing truthful and lawful information. As a result of this registration, the USER may be provided with a password for which he/she will be responsible, committing to making diligent and confidential use of it.

The USER undertakes to make appropriate use of the contents and services that ELRA offers through its Website and, by way of example but not limited to, not to use them to (i) engage in illegal, illegal or contrary to good faith and public order; (ii) disseminate content or propaganda of a racist, xenophobic, pornographic-illegal, apology of terrorism or violation of human rights; (iii) cause damage to the physical and logical systems of ELRA, its suppliers or third parties, introduce or spread computer viruses or any other physical or logical systems on the network that may cause the aforementioned damage; (iv) attempt to access and, where appropriate, use the e-mail accounts of other USERS and modify or manipulate their messages.

ELRA reserves the right to withdraw all comments and contributions that violate respect for the dignity of the person, that are discriminatory, xenophobic, racist, pornographic, that violate youth or childhood, public order or security or that, in its opinion, are not suitable for publication.

Data Protection

ELRA complies with the guidelines of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, on the protection of individuals with regard to the processing of personal data and on the free movement of such data, the Belgian Law of 30 July 2018 on the protection of natural persons with regard to the processing of personal data, and other regulations in force at any given time, and ensures the correct use and processing of the USER’s personal data.

For this purpose, together with each form for the collection of personal data, in the services that the USER may request from ELRA, ELRA will inform the USER of the existence and acceptance of the particular conditions on the processing of his/her data in each case, informing him/her of the responsibility of the file created, the address of the data controller, the possibility of exercising his/her rights of access, rectification, cancellation, opposition, erasure, restriction and portability of personal data, the purpose of the processing and communications of data to third parties where appropriate.

Intellectual and Industrial property

ELRA is the holder of the Intellectual and/or Industrial Property rights of this Website, as well as of its content.

The texts, images, graphics, logos, buttons, software files, colour combinations and the structure, selection, sorting and layout of its contents and other elements of this site are protected by intellectual property laws and international treaties. Any reproduction, transmission, copy, adaptation, modification, or any other exploitation in any way or by any means, is strictly prohibited.

The USER undertakes to respect the Intellectual and Industrial Property rights owned by ELRA. You may view the elements of the Website and even print, copy and store them on the hard drive of your computer or on any other physical medium provided that it is solely and exclusively for your personal and private use. The USER must refrain from deleting, altering, evading or manipulating any protection device or security system installed in the ELRA Websites.

Disclaimer of Warranties and Liability

ELRA is not responsible, in any case, for any damages of any nature that may be caused, including but not limited to: errors or omissions in the contents, lack of availability of the Website or the transmission of viruses or malicious or harmful programs in the contents, despite having taken all necessary technological measures to prevent it.
Use of Cookie Technology

ELRA may use Cookies to personalize and facilitate the USER’s navigation of its Website as much as possible. Cookies are only associated with an anonymous USER and his/her computer and do not provide references that allow the USER’s personal data to be deduced.

The USER may configure their browser to notify and reject the installation of cookies sent by ELRA, without this affecting the possibility of the USER to access the Content.

Third-Party Sites

In the event that the Website contains links or hyperlinks to other Internet sites, ELRA shall not exercise any control over such sites and content. Right of Exclusion

ELRA reserves the right to deny or withdraw access to its Website and/or the services offered without prior notice, at its own request or at the request of a third party, to those USERS who breach these General Terms.

ELRA may at any time modify the General Terms set forth herein by publishing it as it appears here. The validity of the aforementioned Terms will depend on its exposure and will remain in force until it is modified by other duly published Terms.

PERSONAL DATA PROTECTION POLICY

Personal Data Protection Policy

In compliance with the Belgian Law of 30 July 2018 on the protection of natural persons with regard to the processing of personal data, and the Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, ELRA (European Land Registry Association) hereinafter referred to as ELRA) reports the following:

• ELRA acts as the responsible for the treatment, whose identifying data is found in the document’s heading.
• The legal basis of the treatment is the user’s acceptance of the legal conditions of this website.
• No recipients of the users’ personal data are foreseen, except in cases of legal requirement or in cases in which providers are contracted to give any service offered by ELRA.
• No international data transfers are planned.
• Data will not be processed with the aim to make automated individual decisions, including profiling.

Collection, purpose and processing of data

ELRA has the duty to inform the USERS of its Website about the collection of their personal data that may be carried out, either by sending an e-mail, by completing the forms included in the Website itself or by registering for personalized services. In this sense, ELRA will be held as controller for the data collected through the means described above.

In the same terms, ELRA informs the USERS that the purpose of the processing of the data collected includes: the attention of requests made by the USERS, the inclusion in the agenda of contacts, the provision of services and the management of the commercial relationship.

The operations, formalities and technical procedures carried out in an automated or non-automated manner and that make possible the collection, storage, modification, transfer and other actions on personal data, are considered processing of personal data. All personal data collected through the ELRA Website, and therefore considered to be personal data processing, will be incorporated into an internal record of ELRA ‘ processing activities.

ELRA , being responsible for handling the data, will adopt the technical and organizational measures required to guarantee the security of the personal data provided, preventing their unauthorized alteration, loss, manipulation or access.

Disclosure of information to third parties

ELRA informs USERS that their personal data will not be transferred to third parties, except when such transfer of data is covered by a legal obligation or when the provision of a service involves the need for a contractual relationship with a processor. In the latter case, the transfer of data to the third party will only take place when ELRA has the express consent of the USER.

Confidentiality

The personal data collected by ELRA through the Website or through the different communications that are maintained with the USER will be treated confidentially, and ELRA undertakes to keep them secret in accordance with the applicable legislation.

In the event that the Website contains links or hyperlinks to other Internet sites, ELRA shall not exercise any control over such sites and content. Rights of the Data Subject/User

The purpose of the Personal Data Protection Act (LOPD) and the Regulation (EU) 2016/679 is to guarantee and protect, with respect to the processing of personal data, the public freedoms and fundamental rights of individuals, and especially their personal honour and privacy. The measures to guarantee this protection include the rights of access, rectification, cancellation, opposition, erasure, restriction and portability of personal data:

• The right of access to a copy of the information comprised in their personal data
• The right to receive the personal data of their concern
• The right in certain circumstances to have inaccurate personal data rectified, blocked, erased, restricted or destroyed
• The right to block, erase, restrict or destroy their personal data

Therefore, at any time, the user can revoke the consent to the treatment or exercise his/her rights of access, rectification, deletion, portability, opposition and limitation to the treatment, either by informing ELRA through an email to secretariat@elra.eu, or to the postal address indicated above, indicating “Data Protection” as the subject. In both cases, an official document must be provided in order to allow the identification of the user and to prevent access to his/her data by third parties.

At the same time, the user will be able to submit a claim to the Data Protection Control Authority to assert his/her rights.

Types of cookies
