Does registration create rights that prevail over any rights that have not been registered?
La publication d’actes au fichier immobilier a pour effet de les rendre opposables aux tiers.
Does registration have constitutive effects -i.e. without registration there is no real right created- in every case or in some cases -mortgages for instance-?
Une hypothèque n’a d’effet qu’à compter de sa date de publication au fichier immobilier. A défaut, elle est dépourvue de conséquence vis à vis des tiers.
Is registration constitutive or compulsory? Is there a strong presumption by law of the validity of rights contained in the register unless the court decides otherwise? Is there definitive validity in case of a bona fides purchaser whose rights cannot be disturbed because he acquired them based on the content of the register and has registered his acquisition, even though the seller’s title later found to be fundamentally null?
Le système français de la publicité foncière est fondé sur la tenue d’un fichier. L’accomplissement de la formalité de publicité foncière ne réalise pas le transfert des droits. Il est simplement indicatif de droits et n’a pas de fonction probatoire. Ceci en raison du principe en droit civil français selon lequel le transfert de propriété se réalise par le seul échange des consentements. Comme le droit préexiste à la formalité de publicité, celle-ci a seulement pour fonction de rendre l’acte efficace à l’égard des tiers.
Do the officcials in charge fo registration control the documents before registration? Is the control in the sense of a formal point of view and/or from a material point of view so as to assure that only valid conveyances will enjoy the protection of the Land Registry? Is it possible to process a temporary registration pending correcting possible faults?
La conservation des hypothèques ne contrôle pas la validité au fond des formalités déposées, hormis le cas des mainlevées d’hypothèques autres que simplifiées. Elle doit s’assurer que la formalité présentée entre dans le champ d’application de la publicité foncière, que tous les éléments nécessaires à sa prise en compte sont mentionnés et que le propriétaire du bien est bien inscrit en cette qualité au fichier immobilier.
