1. Sort of registrations or records. Please, describe your LR system criteria regarding the type of registration applied.

This is an accurate description of the register of title in England and Wales.

2. Deadlines for registration. Must land registrars or LR offices make the registrations or entries requested within deadlines? Please, if applicable indicate which are.

There are no deadlines for the land registry.

An application for first registration, where first registration is compulsory, must be made by the buyer or the mortgagee within two months from the date of the transaction, otherwise the transfer, grant or creation of the interest in land becomes void.

The title of the legal estate reverts to the original owner, who holds it on trust for the transferee, or holds it subject to a contract to grant or create the legal estate concerned.

3. Registration fees. Please, describe the main features of payment of LR fees. If you find it useful, suggest an example of registration fees of a sale of a property valued in € 100.000 and if it’s possible a mortgage.

Registration fees are prescribed by Land Registration Fees Orders, which are updated regularly. They are paid by cheque, or more often by direct debit. Private citizens can pay by credit or debit card.

Most fees for registering transfers, mortgages, and first registration are scale fees; that is the fee will depend on the value of the land or the mortgage, if it is registered separately. So for instance, from 17 March 2014 the fee for a first registration or a transfer of registered land with a mortgage completed at the same time will be:
– Amount or value – £80,001 – 100,000 : fee £80
– Amount or value – £100,001 – 200,000 : fee £190
– The maximum fee is £910 for properties of £1,000,001 and over.

In all cases except for first registrations there will be a reduction of fee by 50% if the application is lodged electronically. Applications for first registration cannot be lodged electronically, as we need to inspect the original deeds.

For a transfer not for monetary consideration, or registration of a mortgage completed separately, the fee will be:
– Amount or value £0 – £100,000: fee £40
– Amount or value £100,001- £200,000: fee £60
– The maximum fee is £250 for properties or mortgages valued at £1,000,001 and over.

In all cases there will be a reduction of fee by 50% if the application is lodged electronically.

There are also a large number of fixed fees for making entries in the register relating to other interests in land, such as notices of easements or restrictions. These are mostly £40, and from 17 March 2014, £20 if the application is delivered electronically.

Most applications for information services (official copies of the register, documents and official searches) are £3 for electronic applications and results, or £7 for paper applications.
