1. With respect to the registration of the apartments of the condominium: are there any specific formal characteristics of the registration related to the condominium or any characteristics that indicate that such apartments are subjected to a condominium, such as a formal statement, a number or other sign in the condominium or the corresponding share related to each apartment?NT?

There are four kind on immovables:

  • An immovable (plot of land);
  • Right of superficies;
  • Apartment ownership;
  • Right of superficies in apartments.

In addition to the characteristics which are usually registered (land registry jurisdiction, cadastral code of the registered immovable, specific purpose of the registered immovable etc.), the location and number of the apartment, the total area of the physical share of the apartment ownership, the size of the legal share of common ownership and the numbers of the other apartment ownership register parts are also entered in the first division of the register part. The name of the apartment owner shall be entered in the second division. If the apartment ownership is in shared ownership, the names of the joint owners and, in the case of common ownership, also the sizes of the shares shall be indicated.

2. Anyway, does registration of the apartment include the share of the apartment related to the global condominium?

Yes, the size of the legal share of common ownership corresponding to the physica share of the apartment ownership is also registered in the land register.

3. What type of relationship is there between the registration of the building and the registrations of the apartments? Are the building and the apartments in absolutely separated registrations, with no connection at all?

Buildings and apartments as well as building permits and permits of use are registered in the national building register, apartment ownership in the land register. For registration an apartment ownership an existence of the building is not necessary, building permit and copy, issued by the registrar of the national building register or the administrative agency which issued the building permit or permit for use, of the plan of the building to be divided into apartment ownerships or of the design of the building to be built is needed.

Building register and land register are technically connected by the x-road, so one may easily see data in both register.

4. Which physical data of the apartments are usually collected in the registration to describe the property? (Floor or storey where located, surface, boundaries, access, rooms, postal address, cadastral code).

5. If registrations in your system refer to a plan or to the cadastral map, how (if at all) does the plan show the position (horizontal and vertical) of the apartment within the building?

Plan of the building to be divided into apartment ownerships or of the design of the building to be built is necessary. It is horizontal, usually each floor separately and it sets out the delimited premises of the physical share of each apartment ownership, marked with an apartment number. This means that one must always see the plan to understand where is the physical share of object of apartment ownership.

There may also be the plan of immovable in case owners of the apartment ownership agree to use the common property in some specific way.
