Home / European Land Registry Network / The Netherlands / Differences between exclusive rights over the apartments and rights over buildings

Please, explain briefly but as clearly as possible the scope of the rights relating (exclusively) to the apartments and the ones relating to the building or to the communal elements owned jointly.

The apartment right consists of 4 elements that cannot be separated from each other:

  • common ownership of land AND building
  • the exclusive right to use some specific areas of land or building
  • the right to co-use all the common areas of land or building
  • obligatory membership of “de vereniging van eigenaars” (the association of owners”. The goal of the association of owners is to represent the owners and their interests.
