By section 36 of the Land Registration etc. (Scotland) Act 2012 (the 2012 Act), the date on which RoS receives an application becomes the date of registration. All applications submitted for registration must satisfy the conditions for registration. Any application failing to satisfy these conditions will be rejected and the date of registration lost.

Section 39 of the 2012 Act requires RoS to deal with two or more applications for registration in relation to the same plot of land in order of receipt. The order of receipt is taken to be the order in which the applications were entered in the application record unless there is sufficient evidence to the contrary.
