The property of foreigners: challenges
- How much data is collected by your national land registry about a foreigner when making a real estate transaction?
The same information as for national people plus its nationality, so:
Name, surname, ID number, if its married/divorced/widower- if it’s married the matrimonial regime-, domicile and nationality.
The data is taken from the document that is going to be registered, and it is incorporated into the system in a structured way.
2. Do you use a uniform person identification number?

2.1. If Yes, do you use persons assigned number or make your own national number?
In the public deed they must express their National ID Number/Passport Number to be identified, and additionally, to acquire goods in Spain they must have what is called NIE (Foreigner Identification Number), that is issued by the police department. In the Registry Entry we must compulsory include the NIE for foreigners, according to article 9 Mortgage Law and 51 of the Mortgage Ruling.
3. Do all State information systems use the one/same person identification number?
Depending on the administrative operation that is made, only the identification of the foreigner is required (their national identification documents), or it is also required the abovementioned NIE (usually when it involves taxation), but there is ONLY ONE NIE given to a certain person (as any ID number).
