1. Does your national regulation provide for the possibility of registering a partnership?

Between 1995 and 2009 It used to be possible to register partnerships in Sweden. The marital act was changed and from 2009 all couples can be married. Those that were registered as partners can decide whether they wish to remain as registered partners or if they want to convert the registered partnership into a registered marriage. Today all couples are married regardless if they have the same or different gender.

See answer to question 1. No new registered partnerships are being registered. People of the same gender are married.

2. Is there a statutory property regime for partnerships whether registered or not?

The Swedish Marital act and property regime is the same regardless if the spouses are of the same or different gender. There is also a special regulation for non married cohabitees living together. Also this regulation applies regardless if the couples are of the same or different gender.

3. And are there any restrictions on the freedom to establish a property regime?

The same rules apply as for all married couples. As a main rule all property is marital property but can be transformed into private property, mainly through prenuptial agreements or marriage agreements.

4. Can a partnership registered in another member state or in a third state have patrimonial effects in your national regulation?

Yes

5. Does the dissolution of a non-marital partnership produce succession effects?

No: Not succession effects but it does provide certain similar rights to the joint dwelling and household goods, and a division of property agreement can be drawn after the relationship was dissolved.

5.1. Is it possible to register the right to family home in case of decease or breakout of non-marital partnership?

Yes, it is possible. The couple can decide to make a special remark about this in the land registry.
