Malaga, 24th of November

The last workshop of the year took place in Malaga, Spain. Representatives from 17 countries attended the event.

The training opened up with a presentation about the study on Regulation (EU) 2018/1805 on the mutual recognition of freezing orders and confiscation orders by Jorge López, Spanish land registrar, followed by a round table.

We continued with a summary of the CPs contributions on Data Protection in LR questionnaire by Claude Sapiano, Contact Point from Malta.

The next panel was about the «international circulation of digital public documents» by Guillermo Palao, International Private Law Professor at University of Valencia. The presentation followed by an update on the ELRA study about the free movement of public documents, by Fernando de la Puente, Spanish Land and Business Registrar

One of our main invited speakers was Marie Vautravers, Secretary General of the European Judicial Network, who talked about the current challenges of cross-border protection of vulnerable adults and minors. Our Secretary General, Francisco J. Gimeno, completed the presentation by talking about the role of land registry in this matter.

To end with, we had a presentation about the Regulation 2015/848 on insolvency proceedings: Establishment and interconnection of insolvency registers by Blandina Soares, Conservadora dos Registo Civil, Predial e Comercial de Portugal. Then our Secretary General made un update of the existing Fact Sheet regarding insolvency and LR.

Online, 23rd of June

The second workshop of the year took place virtually and representatives from 12 countries joined.

Given the ongoing situation in Ukraine, ELRA was asked to join a Task Force sub-group on asset freeze and reporting created by DG Fisma, European Commission, on the Implementation of restrictive measures in the framework of Regulation (EU) 2022/396. We had the opportunity to count with representatives of the EC on the matter, who explained the sanctions the EU is carrying out as well as the aim and progress of the above-mentioned working group. Our ELRN coordinator and Secretary General, Francisco J. Gimeno, presented the contributions of ELRA members to the Task Force subgroup.

This was followed by a presentation Data Protection in the Land Registry by Filipa Calvão, President of the National Data Protection Committee, Portugal.

Our CP from Malta, Claude Sapiano, also presented a question on the topic that will be addressed by the CPs and followed by a study on the topic.

To end with, the progress of the study on «free movement of public documents», launched by Fernando de la Puente at the beginning of the year, was presented and followed by a round table. The study will continue and the conclusions of the same will be presented when it has concluded.

Brussels, 4th of March

The first seminar of the year took place on the 4th of March in Brussels and brought together members of 21 European countries in a hybrid format.

A study on the «free movement of public documents» was launched by Fernando de la Puente, former ELRA President, and followed by a round table. The conclusions of the study will be presented in November, in our last workshop of the year.

Dr Marta Rekawek -Pachwicewicz, Chief Specialist in the Ministry of Justice of Poland, presented the conclusions and feedbacks of the «Study Case: C-301/20: the validity of a certified copy not having an expiration date». Same was done by Agostina Lodde,CP from Agenzie delle Entrate, for the study on «Digitalization of paper documents»

Later, an ongoing study on «Regulation (EU) 2018/1805 on the mutual recognition of freezing orders and confiscation orders» was presented by Jorge Lopez, Spanish Land Registrar.

Report on 3D representation in the Land Registry was presented by Joke De Wit and Mohammed Kammachi from the General Administration of the Patrimonial Documentation from Belgium.

Afterwards, Ivica Anaković, CP from Croatia Comparative study: Republic of Croatia and ELRA member states land registry systems and Francisco J.Gimeno, ELRA Secretary General, presented some internal topics to end with.

ELRN Workshops 2021

Brussels, 25th November

The third seminar of the year took place in Brussels, on the 25th of November 2021 and brought together Contact Points from 9 European countries in person. It was followed online by the CPs from other 12 European countries who could not attend.

The ELRN is closely following the implementation of European Instruments and particularly, the Succession Regulation (EU) No 650/2012. For this purpose, we count with the honourable participation of Maria-Vilar Badia, DG Justice of the European Commission, who explained in detail the European Certificate of Succession (ECS). It was followed by a Study Case C-301/20, about the validity of a certified copy not having an expiration date by Marta Rekawek, Chief Specialist and Judge in the European Law department in Poland. Afterward, we had a round table on the topic, moderated by David Fridh, CP from Sweden and ELRA Board member.

Recalling ELRA participation in EU Adapt project, Luisa Clode, ELRA Secretary General, presented the state of play of the project as well as the results of the contributions of the CPs to the same through a questionnaire.

The EU land registrar status was presented by Mihai Taus, CP from Romania.

Another topic of interest during the seminar was the Digital Transformation and the digitalization of paper documents. Agostina Lodde, CP from Agenzia delle Entrate, Italy, presented the results of the questionnaire on the topic and it was followed by a round table moderated by Kadri Laud, CP from Estonia and ELRA Board Member

After the break, ELRA President, Fernando de la Puente, introduced a new ELRN study: free movement of public documents in the EU regulations. We had the pleasure to count with the participation of the new Secretary General of the European Judicial Network in Civil and Commercial Matters (EJN), Maria Vautravers, who presented an overview of the Regulation (EU) 2016/1191 on the topic.

Besides, Jacques Vos, CP from the Netherlands presented a study on EU property taxes.

The seminar finished with a presentation of the role of Land Registrars in facing natural disasters, the case of La Palma, Spain, by Francisco Gimeno, CP from Spain.

To end with, some internal topics were discussed, and upcoming events were announced by ELRA President.

Videoconference, 17th June

The second seminar of the European Network of Land Registrars was held the 17th of June and brought together Contact Points from 19 European countries. The ELRN met in fulfilment of the annual work plan which is part of the EU priorities on judicial cooperation in civil matters.

We had the pleasure to count with the participation of the new Secretary General of the European Judicial Network in Civil and Commercial Matters (EJN), Maria Vautravers, who opened the seminar by introducing the main tasks and goals of the network.

In the framework of the ELRN’s ongoing study on the role of registers in the fight against money laundering, Maria José Magalhaes presented the contributions of the Contact Points to a questionnaire on the subject followed by a round table moderated by Jan Moerkerke, member of the ELRA Board of Directors and coordinator of the study.

Contact Points’ contributions on Property Effects of Registered Partnership were also presented during the workshop, by Fatima Ferreira

Afonso Patrao, law Professor at University of Coimbra, presented the EU ADAPT Project, which aim is to facilitate cross-border successions and in which ELRA is collaborating as anassociated partner.

Sergio Saavedra, director of the technical coordination office, presented objectives of the Ibero-American Registry Network (Iberoreg).

The last presentation was made by our Scottish colleagues, about the swich from conventional registration to the cloud.

To end with, some internal topics were discussed, and upcoming events were announced.

Videoconference, 11th March

The first seminar of the European Network of Land Registrars, which brought together 28 registry organisations across Europe, was held on the 11th of March 2021. The Network met in fulfilment of the annual work plan which is part of the EU priorities on judicial cooperation in civil matters.

The study of digital transformation by legal authorities and professions, including the implementation of electronic signatures in registers, was among the priorities of this year. Portuguese Land Registrar Blandina Maria da Silva Soares presented on the topic.

Within the research already initiated at the ELRN, we highlight the presentation on the Contact Points’ contributions to the questionnaire on 3D representation in the Land Registry, as well as Fatima Ferreira’s presentation on the effects on the registered partnership.

The seminar then closed with a presentation given by Benjamin Verheye from the Institute for Property Law (KU Leuven University) about Land Registration and Sustainability.
